Registering designs protects the appearance of items. A  registered design can be used to prevent others from stealing or using your design or applied decoration. If someone else uses your design, you can take legal action against them for infringing your design. A registered design take over where a patents leaves off. There are several ways to protect against exploitation by others of your design. We offer UK, European Community, US and International design attorney services.

UK REGISTERERD DESIGNS

UK design registration covers only the UK. Registration of a design is usually automatic, subject to the possibility of opposition by others if they feel that the design is too close to one that they already own. Once registered, the design protection lasts for an initial period of 5 years which can be extended by four further periods of 5 years up to a maximum of 25 Years. There is no limit to the number of different designs which can made in a single design application for protection. A UK design application may be used for filing a design application in other countries up to 6 months after the UK design application date.  Granted Registered Designs are published and can be inspected by the public. EUROPEAN COMMUNITY REGISTERED DESIGNS

European Community registered design protects the outward appearance of a whole product or part of a product, which may result from its lines, contours, colours, shape, texture or ornamentation. The procedure is very similar to registering a UK design, but covers the entire European Community, including the United Kingdom.Just as in the UK, there  is no limit to the number of different designs which can made in a single design application for protection. As in the UK, the period for which a registered design is effective is initially five years, extendable upon payment of renewal fees for four further periods of five years each, giving a total possible lifetime for a design of twenty-five years. A European design can be registered up to 12 months after first disclosure to the public. Unlike UK, it  is a unique feature of European Community Designs that an application can be filed and granted, but not published until 30 months after the initial design application filing date. This can be of use to anyone who needs protection for a design, but also needs secrecy for the design until a specific date, such as car designers, fashion designers, persons doing work connected with new company names, and so on. A European Community design can also be used up to 6 months after the initial design filing date to support a filing a design application   in a further non-EU country. DESIGNS OUTSIDE THE UK AND EUROPE

Design applications can be filed directly in many foreign countries and based upon an earlier design application filed in the UK or the EU within the previous six months to preserve the earlier date of filing.  Names for  a design registration can vary. For example, in the USA application must be made for a "Design Patent" which is examined in much the same way as a US Patent Application. There also exits the Hague Convention for international registration of designs, but unfortunately the United Kingdom is not a signatory and is not included in this provision.  We will be happy to use our design attorney IP skills to help and advise you. AUTOMATIC DESIGN RIGHTS

A United Kingdom and a European Community design right also exist, which do not require to be registered. The United Kingdom Intellectual Property Office provides  a very good summary of all of the design right available to you. Contact us if you you wish our assistance in any way.
