WHEN TO FILE
Filing patent applications for your invention outside of the UK, must take place by the end of a one year period from initial patent filing. You can file a US Patent Application, or a Patent Application in any other particular country. You can also file an International Patent Application and a Regional Patent Application such as a European Patent Application. INDIVIDUAL NATIONAL PATENT APPLICATIONS
If you are interested only in obtaining a patent in only one or two other countries, such as Italy or Brazil, you should consider filing individual national patent applications for your invention in those countries. Some countries can only be reached by either an international application or by an individual national patent application, notably Japan, USA and China. INTERNATIONAL PATENT APPLICATIONS
An international patent application is also known as a PCT patent application. In a PCT patent application you can nominate that your initial patent application can be temporarily extended to nearly every country and regional grouping in the world. The temporary extension of potential patent rights lasts 30 months or more from the initial patent filing date, at which time you will need to convert to a number of selected regional and/or national patent applications for your invention. The tactic of filing a PCT patent application can be used to extend the amount of time a patent application goes unexamined, allowing more time as a "patent pending" where competitors are uncertain what patent claims may be granted for your eventual patent. The initial patent application filing can be absorbed into the PCT application and the initial patent filing abandoned allowing the initial patent filing also to have an extended period unexamined. REGIONAL PATENT APPLICATIONS
There exist regional groupings of countries where a single patent application for your invention can be filed covering some or all of the countries in that group. At the end of a common patent examination process, the patent is granted as an individual national patent for those countries in that grouping which you nominate. Groupings exist in Africa, and Eurasia (the former USSR), . Mostly, UK inventors opt for a patent application filed at the European Patent Office covering an area much larger than the EU. A European Patent Application can turn into an individual French, Italian, British and/or Irish patent, for example. The United Kingdom is included in the European Patent Convention.
